What is Act 160?
Act 160 is a law that penalizes underage drinking.

What happens to first-time offenders?
If you receive a ticket, you have two options:

  1. Pay the waiver penalty.
  2. Contest the ticket.

What happens to second-time offenders?
If you are caught using alcohol as a minor an additional time, one of two things can happen:

  1. The State’s Attorney may choose to refer you to Diversion. If so, as a condition of that referral, you will have to relinquish your license for 60 days. You will also have to attend CRASH at your own expense (currently $300) and complete all other requirements assigned by the Diversion Board.
  2. The State’s Attorney does not refer you to Diversion. If you are convicted, you will lose your license for 120 days, you will be required to attend CRASH and will have to pay up to $600 in fines.
